GENERAL TERMS AND CONDITIONS OF USE

PREAMBLE

These General Terms and Conditions of Use (hereinafter referred to as “TCGU”) regulate the access and use of the electronic intermediation platform made available by the company Lithiumtech , with headquarters at Av. da Liberdade Loja 148, 8200-002 Albufeira , NIPC PT517979373 . By accessing and browsing the Platform, the User acknowledges and accepts, without reservation, these Conditions.

Lithiumtech owns the Platform and is responsible for marketing all products available on it. Some products are purchased by Lithiumtech from suppliers for resale. In these cases, the warranty provided is that of the manufacturer or supplier itself, with no additional warranty offered by Lithiumtech .


ARTICLE 1 - COMPANY IDENTIFICATION AND PURPOSE OF THE PLATFORM

1.1. Lithiumtech , a limited liability company duly incorporated and existing in accordance with Portuguese law, with registered office at Av. da Liberdade, store 148, 8200-002 Albufeira , registered under tax identification number PT517979373 , provides and manages a digital platform accessible through the domain www.lithiumtech.co.uk (hereinafter referred to as the “Platform”).

1.2. The Platform aims to allow a direct connection between Buyers and Lithiumtech , facilitating the sale of products, some refurbished, ensuring a safe, transparent and efficient transaction environment.


ARTICLE 2 - DEFINITIONS

For the purposes of these General Conditions, the following definitions are adopted:

  • Platform : technological infrastructure operated by Lithiumtech , including website and mobile applications, which allow commercial intermediation between Buyers and Lithiumtech .

  • User : any natural person, of legal age and with full legal capacity, or legal entity, who accesses the Platform for the purpose of consulting, registering or purchasing products for strictly private and non-commercial purposes.

  • Seller : class entity that uses the Platform to sell goods, assuming full responsibility for the offer, sale, delivery and compliance of the advertised products.

  • Buyer : any User who places an order and purchases products through the Platform.

  • Products : movable goods, with a special focus on electronic equipment that are offered for sale by Lithiumtech on the Platform, such as:

    • DEMOP Electric Scooter Equipment;

    • Equipment for Photovoltaic Solar Systems;

    • New or even refurbished Lithium or Lead batteries.

  • Services : set of functionalities provided by Lithiumtech that allow intermediation, customer support, payment processing, among others.


ARTICLE 3 - REGISTRATION AND CREATION OF USER ACCOUNT

3.1. Access to the Platform's purchasing features requires the prior creation of a User account. To do so, the interested party must provide reliable, complete, and up-to-date personal information, and is responsible for the accuracy of the data submitted.

3.2. By submitting the registration request, the User declares that he/she has read, understood and fully accepted these Terms and Conditions, committing to respect them in all interactions with the Platform.

3.3. Access to the User account is personal and non-transferable, and the User is responsible for the confidentiality of his/her access credentials. In case of suspected misuse or unauthorized access, the User must immediately notify Lithiumtech through the contact channels indicated in Article 9.

3.4. Lithiumtech reserves the right to refuse or cancel, at any time, the registration of any User who violates the rules of conduct set forth in these Conditions or who uses the Platform in an illicit or abusive manner.


ARTICLE 4 - RULES FOR USE OF THE PLATFORM

4.1. The User undertakes to use the Platform in accordance with current legislation, refraining from any practice that may compromise its integrity, security or functioning.

4.2. The following conduct is expressly prohibited:

  • The insertion of false, misleading or information that may mislead other Users or the Seller;

  • The practice of unlawful, offensive, defamatory, discriminatory acts or acts that violate the rights of third parties;

  • The use of software mechanisms or scripts that allow scraping, harvesting or automated extraction of data from the Platform without prior authorization from Lithiumtech ;

  • The reproduction, modification or commercial exploitation of content protected by intellectual property legislation existing on the Platform without the consent of Lithiumtech .

4.3. Failure to comply with the established rules may result in the immediate suspension of the User account, as well as the adoption of appropriate judicial or extrajudicial measures.


ARTICLE 5 - SERVICES PROVIDED AND ASSOCIATED COSTS

5.1. Lithiumtech provides, as a service provider, the following functionalities:

  • Creation and management of User accounts;

  • Direct connection between Buyers and Lithiumtech ;

  • Secure electronic payment methods;

  • Customer support under the terms set forth herein;

  • Quality monitoring and auditing services for marketed products.

5.2. Certain services made available to Buyers, such as intermediation fees and quality assurance, may be subject to the payment of a commission previously indicated before the confirmation of any order.

5.4. Lithiumtech acts as the seller of all products available on the Platform and is directly responsible for all purchase and sale transactions. The sales contract is concluded directly between the Buyer and Lithiumtech , which assumes responsibility for its execution, in accordance with applicable law and the terms and conditions established on the Platform.


ARTICLE 6 - PAYMENT METHODS ON THE PLATFORM

6.1. Online Payment
Payments for orders placed on the Platform must be made using the electronic means provided by Lithiumtech , namely credit cards, PayPal or other payment methods indicated at the time of purchase.

6.2. Security Assurance
Lithiumtech undertakes to adopt all appropriate technical and organizational measures to guarantee the security of financial transactions carried out on the Platform, but cannot, however, be held responsible for any failures attributable to the systems of payment service providers.

6.3. Use of Promotional Codes
The Platform may offer promotional codes, vouchers, or other forms of discounts, which will be subject to the specific conditions defined for each campaign. Unless otherwise stated:

  • Codes are not cumulative;

  • They are non-refundable and non-convertible to cash;

  • Does not apply to shipping costs;

  • They lose validity after the indicated deadline.


ARTICLE 7 - OPERATION OF THE DIGITAL WALLET (VIRTUAL PURSE)

7.1. Lithiumtech provides Users with an electronic wallet associated with their customer account, which can be credited with amounts relating to refunds, compensation or other commercial gestures by Sellers.

7.2. The balance of the digital wallet may be used to make new purchases on the Platform or, at the User's request, transferred to the personal bank account indicated by him/her, without any additional charge.

7.3. Lithiumtech reserves the right to close the digital wallet if it detects signs of fraud, abusive use or violation of these Conditions, upon prior notice to the User.


ARTICLE 8 - CLOSING OF USER ACCOUNT

8.1. Voluntary Termination by the User
The User may close his/her account at any time, without the need for justification, simply by accessing the account management area or contacting Lithiumtech 's legal department , using the means indicated on the Platform.

8.2 . Termination at Lithiumtech 's initiative
Lithiumtech may unilaterally close a User account in the event of serious non-compliance with these Conditions, especially in situations of :

  • Fraudulent or unlawful use of the Platform;

  • Repeated violation of rules of conduct;

  • Refusal to accept updated versions of the General Conditions.

8.3 . Consequences of Closure
Closing an account will result in the loss of access to the account and the associated digital wallet. Users must withdraw any remaining funds before the effective date of account closure. Lithiumtech is not responsible for the loss of access to information not transferred by the User.


ARTICLE 9 - COMMUNICATION AND MANAGEMENT OF COMPLAINTS

9.1. Requests Related to Platform Services
Users may contact Lithiumtech for clarifications, suggestions or complaints regarding intermediation services through the contact channels available on the Platform, including an online form or email.

9.2. Product-Related Complaints
Complaints regarding Products sold must be submitted directly to Lithiumtech through the platform's features. Lithiumtech will provide support in mediating the dispute, but assumes no direct responsibility for resolving the complaint.

9.3. Response Deadline
Lithiumtech undertakes to acknowledge receipt of any complaint within a maximum period of 5 (five) business days, ensuring that it is dealt with promptly, without prejudice to the applicable legal deadlines .


ARTICLE 10 - RESPONSIBILITIES AND LIMITATIONS

10.1. Liability for Services Provided by Lithiumtech
Lithiumtech is committed to ensuring the availability and operability of the Platform, with the exception of periods required for maintenance operations, technical updates or force majeure situations .

10.2. Product Liability
Lithiumtech is responsible for the Products made available and sold on the Platform, including the accuracy of the descriptions, quality, compliance and legal guarantee.

10.3. Limitation of Liability
Under no circumstances shall Lithiumtech be held liable for indirect losses, lost profits or any consequential damages resulting from the use or inability to use the Platform.


ARTICLE 11 - PERSONAL DATA PROTECTION POLICY

11.1. Lithiumtech ensures full compliance with applicable legislation regarding the protection of personal data, namely the General Data Protection Regulation (GDPR) .

11.2. Personal data collected within the scope of the use of the Platform will be processed for the purposes of managing the contractual relationship, complying with legal obligations, marketing (with consent) and improving the services provided.

11.3. The User may exercise their rights of access, rectification, opposition, deletion, portability and limitation of processing through the channels indicated in Lithiumtech 's Privacy Policy .


ARTICLE 12 - APPLICABLE LAW AND DISPUTE RESOLUTION

12.1. These General Conditions are governed by Portuguese law.

12.2. In the event of a dispute regarding the interpretation or execution of these Terms, the User and Lithiumtech undertake to make every effort to reach an amicable solution.

12.3. The User may resort to alternative dispute resolution methods, in particular consumer dispute resolution entities or the European Commission's online dispute resolution platform.

12.4. In the absence of an agreement, the court of the district of Faro shall have jurisdiction to resolve the dispute, with express waiver of any other.
